1. Introduction and Acceptance
1.1. These Terms and Conditions ("Terms") comprise the terms of a legal agreement between More Group Pty Ltd (ACN 081 408 273) trading as MoreDent or any of its other registered businesses (“MoreDent”, “More Group Pty Ltd”, “our”, “us” or “we”) and you ("the User", “you”, “your”).
1.2. They govern your access to and use of this implant simulation tool (the "Tool"), whether you access the Tool via our website or via the website of a dental practitioner or other third party on which the Tool is embedded or to which it is linked (a "Host Website").
1.3. By accessing and using the Tool, you acknowledge that you have read, understood, and agree to be bound by these Terms.
1.4. If you do not agree to these Terms, you must immediately cease using the Tool.
1.5. Scope: These Terms apply only to the Tool. They do not govern your use of our website or of any Host Website generally, each of which is subject to its own terms of use and privacy policy.
1.6. Host Websites: The Tool is operated by MoreDent. The operator of a Host Website is not a party to these Terms, and MoreDent does not control and is not responsible for the content, availability or practices of any Host Website. Nothing in these Terms affects any separate relationship between you and your dental practitioner.
2. Nature of the Implant Simulation Tool
2.1. Visualisation Aid: The Tool is a visualisation and marketing tool designed to generate simulated images of potential dental outcomes using artificial intelligence, the results of which are downloadable as a jpg image (the “simulation”).
2.2. Not a Treatment Plan: Any image generated by the Tool does not constitute a clinical treatment plan, medical or dental advice, or a diagnosis. It is generated automatically and has not been reviewed by a qualified health professional prior to display. It must not be relied upon as a substitute for professional medical or dental advice.
2.3. No Guarantee of Result: MoreDent does not guarantee that the results from the simulation can be achieved in reality. The simulation is an artistic approximation produced for illustrative purposes only.
2.4. Your Acknowledgment: You acknowledge and agree that:
- You have read and understood clauses 2.1, 2.2 and 2.3, and will not use or rely on the simulation for any clinical assessment, diagnosis or treatment planning.
- You will seek appropriate professional medical or dental advice for any medical view, opinion or discussion, or any proposed treatment, that you consider relating to the simulation.
3. Data/Information – Capture, Processing and Use
3.1. Storage of Information:
- Server Storage: MoreDent may in its absolute discretion capture and store your images, your personal information and the simulation generated by the Tool on its servers or elsewhere.
- Data Wipe: Upon closing the browser, refreshing the page, or after 1 hour of inactivity, the session data is automatically cleared from your browser (this does not affect any images, personal information or simulations stored by MoreDent under the preceding paragraph). It is your responsibility to download any jpg before the session expires. MoreDent will not recover lost session data for you.
3.2. AI Integration: By using this Tool, you acknowledge that image data is transmitted to a third party for processing. While MoreDent utilizes secure transmission protocols, we are not liable for the data handling practices of third-party artificial intelligence providers.
3.3. Information You Provide: You acknowledge that, in the course of using the Tool, the Tool collects your photograph and all information you enter into the Tool, including your name, address (including postcode), email address and mobile phone number, and your answers to any questions asked by the Tool (which may include information about your dental health, history and treatment preferences) (together, “personal information”).
3.4. Use of information: You acknowledge that MoreDent may in its absolute discretion use your personal information, uploaded images, the simulation, and any other information stored as a result of using the Tool for any lawful purpose. Without limitation, this includes use for clinical education, marketing and user follow-up. You agree and acknowledge the use may include providing your personal and other information to a third party (including the operator of any Host Website through which you accessed the Tool, such as your dental practitioner) and may result in us or a third party contacting you for the purposes of discussing your simulation and making suggestions for you in relation to the simulation.
4. Privacy & Confidentiality
We handle personal information, including health information, in accordance with the Privacy Act 1988 (Cth) and the Australian Privacy Principles. Our Privacy Policy (available on our website) explains how we collect, use and disclose personal information, including crossborder disclosures where relevant, and forms part of these Terms by reference.

7.3. Cap: To the extent that MoreDent’s liability cannot lawfully be excluded, MoreDent’s total liability for any claim arising out of or relating to the Tool is limited to the amount you paid to access the Tool (if any) or the resupply of the services.
7.4. Tool provided “as available”: The Tool is provided as available and we do not warrant uninterrupted or error-free operation, the accuracy, completeness or currency of any content or visualisation, or fitness for a particular purpose. MoreDent is not liable for errors, "hallucinations," or anatomical impossibilities generated by the AI model.

10. Modifications to the Tool
MoreDent reserves the right to modify, suspend, or discontinue the Tool (including its availability via any Host Website), temporarily or permanently, at any time without notice. We shall not be liable to you or any third party for any modification, suspension, or discontinuance of the Tool.
11. Changes to Terms
We may update these Terms at any time. Changes take effect immediately once published on this Tool. Your continued use of the Tool constitutes acceptance of the updated Terms.

These Terms are governed by the laws of the State of Victoria, Australia. Each party submits to the exclusive jurisdiction of the courts of Victoria and the Commonwealth courts sitting in Victoria.
13. Dispute Resolution
13.1. Resolution: Before commencing proceedings (other than to seek urgent injunctive relief), the parties will attempt in good faith to resolve any dispute through senior-level discussions and, if agreed, mediation.
13.2. Continue to perform: Notwithstanding the existence of a dispute, each party must continue to perform its obligations under these Terms.
